FXDPRO TERMS OF SERVICE

1. OVERVIEW

FXDPRO (“the Service”) provides institutional-grade foreign exchange (FX) market intelligence and analytical data. The Service is currently offered under an Early Access Program and is intended for experienced and sophisticated users for evaluation and analytical purposes only.

2. EARLY ACCESS & MODIFICATIONS

As an Early Access Service, FXDPRO is provided on a controlled release basis. We reserve the right to modify, suspend, or discontinue any feature, data feed, or the Service itself at any time without prior notice. Performance, availability, and data accuracy may vary during this phase.

3. NO FINANCIAL ADVICE (DISCLAIMER)

FXDPRO is NOT a financial advisor, broker, or tax consultant. All information, data, and insights provided by the Service are for informational and educational purposes only.

  • No content within the Service constitutes investment, trading, or financial advice.
  • You are solely responsible for any investment or trading decisions you make.
  • FXDPRO does not guarantee any specific financial result, profit, or performance.

4. NO WARRANTY & “AS-IS” PROVISION

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FXDPRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • The accuracy, completeness, or reliability of market data.
  • The continuity, uptime, or availability of the API or data feeds.
  • Fitness for any particular trading strategy, system, or purpose.

5. LIMITATION OF LIABILITY

IN NO EVENT SHALL FXDPRO, ITS OPERATORS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Trading losses or loss of capital.
  • Financial losses arising from data inaccuracies, delays, or service interruptions.
  • Losses resulting from the use of, or inability to use, the Service.

6. PROHIBITED USES

By using FXDPRO, you agree NOT to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Redistribute, resell, sublicense, or lease FXDPRO data to any third party without explicit written consent.
  • Use the Service for high-frequency trading (HFT), latency arbitrage, or execution-sensitive trading.
  • Circumvent usage limits, access controls, or security mechanisms of the Service or API.

7. SUBSCRIPTIONS & CANCELLATION

  • Subscriptions are billed in advance on a recurring monthly basis via approved payment providers.
  • You may cancel your subscription at any time.
  • Due to the digital nature of the Service, no refunds are issued for any remaining subscription period.
  • Access remains active until the end of the current billing cycle upon cancellation.

8. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Naha District Court, Japan.

9. ACCEPTANCE OF TERMS

By creating an account, accessing the API, or using FXDPRO in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
